Terms & Conditions
These Terms & Conditions (“Terms”) govern the access to and use of services provided by Mediclap Health Care (“Mediclap”, “Company”, “we”, “our”, “us”). By availing any service from Mediclap, the user (“Patient”, “Client”, “You”) agrees to be legally bound by these Terms.
1. Scope of Services
Mediclap Health Care provides organized home healthcare services including, but not limited to, nursing care, GDA services, physiotherapy, elder care, ICU setup at home, and medical equipment rental or sale. All services are subject to clinical assessment, operational feasibility, service availability, and acceptance by the Company.
2. Engagement & Non-Solicitation of Staff
All healthcare professionals deployed by Mediclap are engaged exclusively through the Company.
- Any direct engagement, solicitation, or hiring of Mediclap’s nursing staff, GDA staff, or allied healthcare personnel outside the Company’s authorized service framework is strictly prohibited.
- In the event of such unauthorized engagement, the concerned staff member shall be permanently blacklisted and disassociated from Mediclap Health Care.
- Mediclap shall bear no responsibility or liability whatsoever for any medical incident, injury, negligence, loss, or damage arising from services availed directly from such staff.
- Such actions shall be treated as a material breach of these Terms.
3. Payment Terms
- All medical equipment rentals are provided strictly on an advance payment basis with a minimum rental tenure of 15 days.
- Nursing, GDA, physiotherapy, and other healthcare services are billed on a per-day or per-visit basis, as agreed at the time of booking.
- Mediclap reserves the right to withhold, suspend, or discontinue services in case of non-payment, delayed payment, or breach of agreed terms.
4. Refund Policy
- In the event that a client has made an advance payment for services and Mediclap is unable to deliver the confirmed services due to any internal or operational reason, the Company shall process a refund within 5 to 7 working days.
- Refunds shall be processed via the original mode of payment or any other mutually agreed method.
- No refund shall be applicable once the service has commenced, staff has been deployed, or equipment has been dispatched, except as expressly stated above.
5. Cancellation & Rescheduling
- Any cancellation or rescheduling request must be communicated at least 24 hours prior to the scheduled service time.
- If the assigned healthcare professional has already arrived at the patient’s location and the service is declined, the full-day service charge shall be applicable.
- Once medical equipment is dispatched or installed, rental charges are non-refundable.
6. Medical Equipment Purchase & Warranty
- Medical equipment purchased from Mediclap Health Care is non-returnable and non-exchangeable.
- Only warranty coverage shall be applicable, as per the manufacturer’s or Company’s warranty terms.
- Under warranty, Mediclap shall arrange repair or servicing of the equipment. Replacement with a new unit is not guaranteed or implied.
- Physical damage, mishandling, misuse, or unauthorized modification shall void the warranty.
7. Client Responsibilities
The client agrees to:
- Provide complete, accurate, and truthful medical information.
- Ensure a safe, hygienic, and suitable environment for service delivery.
- Follow medical instructions, care protocols, and professional advice provided by Mediclap’s healthcare staff.
- Refrain from any behavior that may compromise staff safety or service quality.
8. Limitation of Liability
Mediclap Health Care acts as a professional healthcare service provider and coordinator.
- The Company shall not be liable for outcomes arising from incomplete disclosures, non-compliance with medical advice, unauthorized staff engagement, equipment misuse, or circumstances beyond its reasonable control.
- Mediclap does not guarantee medical outcomes, recovery timelines, or clinical results.
9. Force Majeure
Mediclap shall not be held liable for failure or delay in service delivery due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, strikes, technical failures, or emergencies.
10. Intellectual Property
All intellectual property, including website content, branding, logos, trademarks, service materials, and digital assets, are the exclusive property of Mediclap Health Care and may not be used, copied, or reproduced without prior written authorization.
11. Amendments
Mediclap Health Care reserves the right to amend, modify, or update these Terms at its sole discretion. Continued use of services following such updates shall constitute acceptance of the revised Terms.
12. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India and shall be subject to the exclusive jurisdiction of competent courts in India.
